Terms of Service

These Terms of Service ("Terms") set out the conditions for using the online store (the "Service") provided by MIYAGEN Trail Engineering ("we", "us"). By using the Service, the customer is deemed to have agreed to all of these Terms.

Article 1 (Scope of Application)

These Terms apply to all matters relating to the customer's use of the Service.

Article 2 (Formation of the Sales Contract)

The sales contract is formed at the moment we send the "Order Confirmation" email after the customer completes the order process on the Service.

We may be unable to accept an order due to stock shortages, production delays, or similar reasons. In such cases, we will contact you promptly and process a cancellation (refund).

Article 3 (Prices and Payment)

  • All product prices are shown including consumption tax. Prices may be changed without notice.
  • Payment may be made via the methods shown at checkout.
  • Fees for credit card and similar payments follow the rules of each payment provider.

Article 4 (Delivery and Transfer of Ownership)

  • Items ship after the order is confirmed (payment received), in line with our separately stated Shipping Policy.
  • Ownership and risk of loss transfer to the customer at the point we hand the item to the carrier.

Article 5 (Returns and Refunds)

Returns, exchanges and refunds are governed by our separately stated "Refund Policy."

Article 6 (Prohibited Acts)

When using the Service, the customer must not engage in the following acts:

  • Acts that violate laws or public order
  • Purchases for the purpose of resale, or similar acts
  • Acts that destroy or interfere with the operation of our servers or networks
  • Acts that infringe the intellectual property rights, privacy or other rights of other customers, third parties, or us
  • Use of the Service for any unlawful purpose

Article 7 (Disclaimer)

  • Except for cases of our intentional misconduct or gross negligence, we accept no liability for any loss arising in connection with the Service.
  • We accept no liability for delays or losses caused by communication line failures, natural disasters, or other events of force majeure.

Article 8 (Intellectual Property)

Copyright and other intellectual property rights in the text, images, designs, product designs and other content on the Service belong to us or to the rightful holders. Unauthorised reproduction, reposting or imitation is strictly prohibited.

Article 9 (Changes to the Terms)

We may change these Terms when needed. The changed Terms take effect from the time they are posted on the Service.

Article 10 (Governing Law and Jurisdiction)

  • The interpretation and application of these Terms are governed by Japanese law.
  • Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the Nagoya District Court or the Okazaki Summary Court as the court of first instance.
